1. Company & Scope of Services

hikingguide.es provides guided and self-guided hiking experiences, route suggestions, and outdoor activities in Andalucía and surrounding regions.

Our services may include:

  • Guided hikes

  • Suggested routes and itineraries

  • Transport coordination

  • Information on terrain, conditions, and logistics

Participation is voluntary, and clients are not required to complete any route or activity suggested or offered.


2. Participant Responsibility & Decision-Making

By participating in any activity associated with hikingguide.es, you acknowledge and agree that:

  • Hiking and outdoor activities involve inherent risks

  • You are responsible for your own decisions, pace, and physical limits

  • You may choose not to participate, stop early, or select an alternative route at any time

Our role is to suggest routes and provide guidance, not to make decisions on your behalf.

The final decision to continue, alter, or abandon a hike always rests with you.


3. Safety Briefings & Conduct

We provide safety briefings and route information at the start of activities.

Participants are expected to:

  • Listen to and respect safety briefings

  • Act responsibly and cooperatively

  • Follow reasonable guidance intended to reduce risk

We reserve the right to:

  • Modify routes for safety reasons

  • Offer alternative options

  • Terminate participation without refund if a participant:

    • Acts unsafely

    • Disregards safety guidance

    • Is disruptive or uncooperative

Safety-related decisions are final.


4. Assumption of Risk

Hiking involves risks including, but not limited to:

  • Slips, trips, and falls

  • Weather exposure

  • Terrain hazards

  • Fatigue or injury

  • Remoteness from medical assistance

By participating, you voluntarily assume all risks associated with hiking and outdoor activities.

Nothing in this document excludes liability that cannot legally be excluded under Spanish or EU law.


5. Fitness, Health & Equipment

Participants are responsible for:

  • Assessing their own fitness and ability

  • Informing us of any relevant medical conditions

  • Wearing appropriate clothing and footwear

  • Carrying sufficient water, food, and personal equipment

We accept no responsibility for injuries or issues arising from inadequate preparation or equipment.


6. Weather & Environmental Conditions

Outdoor activities are weather-dependent.

You acknowledge that:

  • Weather conditions cannot be controlled

  • Routes or activities may be altered or cancelled for safety reasons

Changes or cancellations due to weather or safety considerations do not constitute non-performance of services.


7. Cancellation & Refund Policy

Client Cancellations

  • More than 48 hours before the activity: full refund

  • Less than 48 hours before the activity: no refund

  • No-shows or early departure: no refund

Operator Cancellations

If hikingguide.es cancels an activity due to:

  • Severe weather

  • Safety concerns

  • Unforeseen circumstances

We will offer:

  • An alternative date or

  • A suitable alternative activity or

  • A refund where appropriate

No additional compensation is payable beyond the amount paid, except where required by law.


8. Media, Photography & Image Use

During activities, photos or videos may be taken or shared.

By participating, you agree that:

  • Images in which you may appear can be used for promotional and marketing purposes

  • This may include websites, social media, and printed materials

  • No compensation is due for such use

If you do not wish to appear in images, you must inform us in advance or during the activity.


9. Privacy & Data Protection (GDPR)

Data Controller

The data controller is the operator of hikingguide.es.

Data We Collect

We may collect:

  • Names and contact details

  • Booking and participation information

  • Communications related to activities

  • Images and videos

Purpose of Processing

Data is used for:

  • Managing bookings and activities

  • Communication and safety coordination

  • Legal and administrative purposes

  • Marketing and promotional activities (where applicable)

Legal Basis

Processing is based on:

  • Contractual necessity

  • Legitimate interest

This does not affect mandatory consumer or liability protections under Spanish or EU law.
